nViews Career hereby welcome and thank you for using the nViews career job platform and related products and services (the “Job services”). You agree that by purchasing, registering, or otherwise using the Jobs Services, you are entering into a legally binding contract (even if you are using the Jobs Services on behalf of a business). The Job Posting Services allow your job postings to be posted on nViews career and on third-party websites (collectively, “Sites”), such as websites and mobile applications. The Job Posting Services may be used to target job postings to our members based on non-personally identifiable criteria (e.g., company, industry, job function, and hash email).
nViews Career hereby grants you access to https://nviewscareer.com (“the Website”) and invites you to benefit the services offered.
You agree that by clicking “Join Now”, “Join nViews career”, “Sign Up” or similar, registering, accessing or using our services (described below), you are agreeing to enter into a legally binding contract with nViews career (even if you are using our Services on behalf of a company). If you do not agree to this contract (“Contract” or “User Agreement”), do not click “Join Now” (or similar) and do not access or otherwise use any of our Services. If you wish to terminate this contract, at any time you can do so by closing your account and no longer accessing or using our Services.
Definitions and key terms
To help explain things as clearly as possible in this Eula, every time any of these terms are referenced, are strictly defined as:
- Cookie: small amount of data generated by a website and saved by your web browser. It is used to identify your browser, provide analytics, remember information about you such as your language preference or login information.
- Company: when this policy mentions “Company,” “we,” “us,” or “our,” it refers to Nviews Media Private Limited, (Shop No. 912, Johnson Complex, Pillaiyar Kovil Opp, Rajaji Nagar, Thanjavur, Tamil Nadu 613004 India), that is responsible for your information under this Eula.
- Country: where nViews Career or the owners/founders of nViews Career are based, in this case is India
- Service: refers to the service provided by nViews Career as described in the relative terms (if available) and on this platform.
- Third-party service: refers to advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we think may interest you.
- Website: nViews Career’s site, which can be accessed via this URL: https://nviewscareer.com
- You: a person or entity that is registered with nViews Career to use the Services.
- Users: refers the Registered users are divided into job seekers and employers. Job seekers are the members who are actively involved in searching for job opportunities on our platform. Employers are the members who are actively involved in posting job openings in their team, department, university or industry, or who are involved in the hiring process as a manager on behalf of the team, department, university or industry.
This User Agreement (the “Agreement”) is a binding agreement between you (“User”,“you” or “your”) and Nviews Media Private Limited (“Company”, “we”, “us” or “our”). This Agreement governs the relationship between you and us, and your use of the Company nViews Career. Throughout this Agreement, User and Company may each be referred to as a “Party” or collectively, the “Parties”.
If you are using the website on behalf of your employer or other entity (an “Organisation”) for whose benefit you utilise the website or who owns or otherwise controls the means through which you utilise or access the website, then the terms “User”, “you”, and “your” shall apply collectively to you as an individual and to the Organisation. If you use, or purchase a license or to, the website on behalf of an Organisation, you hereby acknowledge, warrant, and covenant that you have the authority to 1) purchase a license to the website on behalf of the Organisation; 2) bind the Organisation to the terms of this Agreement.
By downloading, installing, accessing, or using the website you: (a) affirm that you have all of the necessary permissions and authorisations to access and use the website; (b) if you are using the website pursuant to a license purchased by an organisation, that you are authorised by that organisation to access and use the website(c) acknowledge that you have read and that you understand this agreement; (d) represent that you are of sound mind and of legal age (18 years of age or older) to enter into a binding agreement; and (e) accept and agree to be legally bound by the terms and conditions of this agreement.
If you do not agree to these terms, do not download, install, access, or use the software. if you have already downloaded the software, delete it from your computing device.
The Application is licensed, not sold, to you by nViews Career for use strictly in accordance with the terms of this Agreement.
You will keep your password a secret
You will not share an account with anyone else and will follow our rules and the law.
Members are account holders. You agree to: (1) use a strong password and keep it confidential; (2) not transfer any part of your account (e.g., connections) and (3) follow the law and our list of Dos and Don’ts. You are responsible for anything that happens through your account unless you close it or report misuse.
You agree that you will:
- Comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws, and regulatory requirements;
- Provide accurate information to us and keep it updated;
- Use your real name on your profile; and
- Use the Services in a professional manner.
You agree that you will not:
- Create a false identity on NViews Career, misrepresent your identity, create a Member profile for anyone other than yourself (a real person), or use or attempt to use another’s account;
- Develop, support or use software, devices, scripts, robots or any other means or processes (including crawlers, browser plugins and add-ons or any other technology) to scrape the Services or otherwise copy profiles and other data from the Services;
- Override any security feature or bypass or circumvent any access controls or use limits of the Service (such as caps on keyword searches or profile views);
- Copy, use, disclose or distribute any information obtained from the Services, whether directly or through third parties (such as search engines), without the consent of NViews Career;
- Disclose information that you do not have the consent to disclose (such as confidential information of others (including your employer));
- Violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets or other proprietary rights. For example, do not copy or distribute (except through the available sharing functionality) the posts or other content of others without their permission, which they may give by posting under a Creative Commons license;
- Violate the intellectual property or other rights of NViews Career, including, without limitation, (i) copying or distributing our learning videos or other materials or (ii) copying or distributing our technology, unless it is released under open source licenses; (iii) using the word “NViews Career” or our logos in any business name, email, or URL except as provided in the Brand Guidelines;
- Post anything that contains software viruses, worms, or any other harmful code;
- Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Services or any related technology that is not open source;
- Imply or state that you are affiliated with or endorsed by NViews Career without our express consent (e.g., representing yourself as an accredited NViews Career trainer);
- Rent, lease, loan, trade, sell/re-sell or otherwise monetize the Services or related data or access to the same, without NViews Career’s consent;
- Deep-link to our Services for any purpose other than to promote your profile or a Group on our Services, without NViews Career’s consent;
- Use bots or other automated methods to access the Services, add or download contacts, send or redirect messages;
- Monitor the Services’ availability, performance or functionality for any competitive purpose;
- Engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Services;
- Overlay or otherwise modify the Services or their appearance (such as by inserting elements into the Services or removing, covering, or obscuring an advertisement included on the Services);
- Interfere with the operation of, or place an unreasonable load on, the Services (e.g., spam, denial of service attack, viruses, gaming algorithms); and/or
All the data you have entered in your profile is publicly visible to others. Do not enter any unwanted content for display to the public.
Your purchase may be subject to foreign exchange fees or differences in prices based on location (e.g. exchange rates).
We may store and continue billing your payment method (e.g. credit card) even after it has expired, to avoid interruptions in your Services and to use to pay other Services you may buy.
If you purchase a subscription, your payment method automatically will be charged at the start of each subscription period for the fees and taxes applicable to that period. To avoid future charges, cancel before the renewal date.
Memberships – Job seekers
nViews career offers basic and premium features for job seekers to effectively use our services.
- Membership plans are subject to the terms and conditions set forth in each plan.
- Ad-free services are provided to premium members (or the name defined in the membership). promotional content is defined as marketing and informational. informative promotional content such as job postings and employer information is not included in ad-free content.
- Support represents only moral and general assistance on application guidelines. Support does not represent any other promises, such as employment, etc. Employers are solely responsible for the content of the job postings and should refer to the contact information with any questions or inquiries. We do not endorse or promise to review applications, conduct interviews, or hire candidates. All hiring processes are the sole decision of the respective employer. nViews Career does not directly or indirectly influence employers in the selection of candidates and we do not endorse any claims.
- We charge the membership fee each month or year as indicated in the plan until you cancel or pause the membership through us. Membership dues are non-refundable.
- Membership is non-transferable.
Memberships – Employers
nViews career offers several plans for employers to effectively use our services.
- Membership plans are subject to the terms and conditions set forth in each plan.
- membership fee and discount offer for job posting services are subject to change based on board decisions.
- We will charge the membership fee each month or year as specified in the plan until you cancel or pause membership through us.
- Membership fees are non-refundable.
- Membership is not transferable or shareable.
Memberships – User Profile
nViews Career gives each member the ability to display their profile information in the public medium in URL format (https://nviewscareer.com/profile/xxx-user-name). Users are free to share the profile information stored in the above URL format.
nViews career publishes the “user profile” content (following the URL https://nviewscareer.com/profile/xxxx) under the Creative Commons 4.0 license. The images, logos, designs are the property of nViews career and are subject to copyright. users are not authorized to modify the property of nViews career.
CC BY: This license allows users to distribute, remix, adapt, and build upon the material in any medium or format, so long as attribution is given to the creator. The license allows for commercial use.
It is your choice whether to include sensitive information in your profile and whether to make that information public. Please do not include personal information in your profile that you do not wish to make public.
It is intended that your information will be displayed as a resume, biography, or profile, or under another name in the online (web) or offline (print) version.
Therefore, it is your responsibility to show or hide the information. To assist you, we have provided the ability to show or hide information, but we do not sell your information in any way.
Jobs Services – Job Seekers
Jobs Services is designed to help job seekers find the information they need in one place.
We hereby state that
- nViews Career is not responsible for any inaccuracies in the content of job postings or related data.
- employers are solely responsible for the content of job postings and therefore should direct any questions or inquiries to the contact information.
- We do not promise that candidates who apply to jobs listed on our platform will be hired anywhere. Reviewing applications, inviting candidates for an interview, or hiring is the sole decision of the respective employer. nViews Career has no direct or indirect influence on employers in the selection of candidates.
Jobs Services – Employers
The Jobs Services are designed to help you reach quality candidates for job opportunities. You are responsible for (i) all postings and content therefor submitted by or on your behalf through the Jobs Services or otherwise to nViews Career, including but not limited to the job descriptions, creatives, trademarks, images, URLs and pixels that comprise the postings or content therefor (collectively, your “Postings”); and (ii) all content and property to which Postings may direct viewers, as well as redirects (“Destinations”).
The Jobs Services also offers the option to “sponsor” a Posting (“Sponsored Jobs”), which, for an additional fee, will secure upgraded placement of the Posting on certain NViews Career pages and emails. NViews Career will otherwise determine the size, placement and positioning of your Postings. NViews Career will serve your Postings as inventory becomes available on the Properties.
The Job Services also offer other services mentioned in the Job Posting Plans and are subject to the terms and conditions described in the Plans. Job Services fees are subject to change.
You are responsible for any activity conducted through your account, including any purchases made or charges incurred. If you identify that you are using the Jobs Services on behalf of a business, you agree that nViews Career may share information about your purchases and use of the Jobs Services with that business, including its representatives and agents. If that business indicates that you are no longer authorized to place ads on its behalf (e.g., if you leave that business or changes roles within that business), you agree you may be removed from accounts associated with that business. You may not resell or transfer access to the Jobs Services to any other party.
nViews career is not responsible for the content of the job ads you post. However, we have the right to review the content of your job ads before posting them on our platform to ensure the credibility of our brand.
We are not permitted to post third-party job ads on your profile. You or the hiring manager are responsible for the job ad.
You may not post job ads that contain malware, spyware, or other malicious code, or otherwise interfere with the operation of the Jobs Services or any device or system, or violate or circumvent any security measures of NViews Career or any third party.
nViews carer is not responsible for click fraud, technological issues or other potentially invalid activity by third parties that may affect the cost of running Postings.
NViews Career may, in its sole discretion, modify, or terminate any part or all of the Jobs Services or suspend your ability to use the Jobs Services. NViews Career may reject or remove any Posting at any time for any reason, regardless of whether or not such Posting was previously accepted or served.
Fees, Payment and Cancellation
You may be offered more than one billing option when you purchase Jobs Services. You agree to pay on the basis and at the rate selected when a Posting, order, or other purchase of Jobs Services was submitted through your account (“Rate”). You also agree to pay all applicable taxes, government charges and foreign exchange fees, If any.
Unless you change or remove your payment method, we may store and update (e.g., upon expiration) your payment method for use with subsequent campaigns, orders and purchases submitted through your account.
Intellectual Property Rights and Privacy
You grant to nViews Career a non-exclusive, worldwide, royalty-free, sublicensable and transferable license to use, copy, modify, distribute and publish your Postings in connection with the performance of the Jobs Services (including for marketing and promotional purposes). You represent and warrant that you own or have all necessary rights (including intellectual property rights) to your Postings (including to grant the license above).
You are entitled to post your job postings on any media, job board or other service to advertise them. You may use images or other digital content created at nViews Career on your behalf anywhere without any notice.
You agree not to, and you will not permit others to:
License, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the Application or make the Application available to any third party.
Modify, make derivative works of, disassemble, decrypt, reverse compile or reverse engineer any part of the Application.
Remove, alter or obscure any proprietary notice (including any notice of copyright or trademark) of nViews Career or its affiliates, partners, suppliers or the licensors of the Application.
All intellectual property rights, including copyrights, patents, patent disclosures and inventions (whether patentable or not), trademarks service marks, trade secrets, know-how and other confidential information, trade dress, trade names, logos, corporate names and domain names, together with all of the good will associated there with, derivative works and all other rights (collectively, “Intellectual Property Rights”) that are part of the Software that are otherwise owned by nViews Career shall always remain the exclusive property of nViews Career (or of its suppliers or licensors, if and when applicable). Nothing in this Agreement grants you (or any Organisation) a license to nViews Career’s Intellectual Property Rights.
You agree that this is Agreement conveys a limited license to use nViews Career’s Intellectual Property Rights, solely as part of the Software (and not independently of it), and only for the effective Term of the license granted to you hereunder. Accordingly, your use of any of nViews Career’s Intellectual Property Rights independently of the Software or outside the scope of this Agreement shall be considered an infringement of nViews Career’s Intellectual Property Rights. This shall not limit, however, any claim nViews Career may have for a breach of contract in the event you breach a term or condition of this Agreement. You shall use the highest standard of care to safeguard all Software (including all copies thereof) from infringement, misappropriation, theft, misuse or unauthorised access. Except as expressly granted in this Agreement, nViews Career reserves and shall retain all rights, title, and interest in the Software, including all copyrights and copyrightable subject matter, trademarks and trademark able subject matter, patents and patentable subject matter, trade secrets, and other intellectual property rights, registered, unregistered, granted, applied-for, or both now in existence or that may be created, relating to the thereto.
You (or the Organisation, if and as applicable) shall retain ownership of all Intellectual Property Rights in and to the work products that you create through or with the assistance of the Software.
Any feedback, comments, ideas, improvements or suggestions (collectively, “Suggestions”) provided by you to nViews Career with respect to the Application shall remain the sole and exclusive property of nViews Career.
nViews Career shall be free to use, copy, modify, publish, or redistribute the Suggestions for any purpose and in any way without any credit or any compensation to you.
Modifications to Application
nViews Career reserves the right to modify, suspend or discontinue, temporarily or permanently, the Application or any service to which it connects, with or without notice and without liability to you.
Updates to Application
nViews Career may from time to time provide enhancements or improvements to the features/ functionality of the Application, which may include patches, bug fixes, updates, upgrades and other modifications (“Updates”).
Updates may modify or delete certain features and/or functionalities of the Application. You agree that nViews Career has no obligation to (i) provide any Updates, or (ii) continue to provide or enable any particular features and/or functionalities of the Application to you.
You further agree that all Updates will be (i) deemed to constitute an integral part of the Application, and (ii) subject to the terms and conditions of this Agreement.
The Application may display, include or make available third-party content (including data, information, applications and other products services) or provide links to third-party websites or services (“Third- Party Services”).
You acknowledge and agree that nViews Career shall not be responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect thereof. nViews Career does not assume and shall not have any liability or responsibility to you or any other person or entity for any Third-Party Services.
Third-Party Services and links thereto are provided solely as a convenience to you and you access and use them entirely at your own risk and subject to such third parties’ terms and conditions.
Term and Termination
This Agreement shall remain in effect until terminated by you or nViews Career.
nViews Career may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.
This Agreement will terminate immediately, without prior notice from nViews Career, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the Application and all copies thereof from your computer.
Upon termination of this Agreement, you shall cease all use of the Application and delete all copies of the Application from your computer.
Termination of this Agreement will not limit any of nViews Career’s rights or remedies at law or in equity in case of breach by you (during the term of this Agreement) of any of your obligations under the present Agreement.
You agree to indemnify, defend and hold harmless nViews Career and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable attorneys’ fees, arising from or relating to: i) your use or misuse of the Software; ii) your failure to comply with any applicable law, regulation, or government directive; iii) your breach of this Agreement; or iv) your agreement or relationship with an Organisation (if applicable) or any third party. Furthermore, you agree that nViews Career assumes no responsibility for the information or content you submit or make available through this Software or the content that is made available to you by third parties.
The Application is provided to you “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, nViews Career, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Application, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, nViews Career provides no warranty or undertaking, and makes no representation of any kind that the Application will meet your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.
Without limiting the foregoing, neither nViews Career nor any nViews Career’s provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Application, or the information, content, and materials or products included thereon; (ii) that the Application will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Application; or (iv) that the Application, its servers, the content, or e-mails sent from or on behalf of nViews Career are free of viruses, scripts, trojan horses, worms, malware, time bombs or other harmful components.
Some jurisdictions do not allow the exclusion of or limitations on implied warranties or the limitations on the applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to you.
Limitation of Liability
Notwithstanding any damages that you might incur, the entire liability of nViews Career and any of its suppliers under any provision of this Agreement and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by you for the Application.
To the maximum extent permitted by applicable law, in no event shall nViews Career or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, for loss of data or other information, for business interruption, for personal injury, for loss of privacy arising out of or in any way related to the use of or inability to use the Application, third-party software and/or third-party hardware used with the Application, or otherwise in connection with any provision of this Agreement), even if nViews Career or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.
Some states/jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
If any provision of this Agreement is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
No failure to exercise, and no delay in exercising, on the part of either party, any right or any power under this Agreement shall operate as a waiver of that right or power. Nor shall any single or partial exercise of any right or power under this Agreement preclude further exercise of that or any other right granted herein. In the event of a conflict between this Agreement and any applicable purchase or other terms, the terms of this Agreement shall govern.
Amendments to this Agreement
nViews Career reserves the right, at its sole discretion, to modify or replace this Agreement at any time. If a revision is material we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Application after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Application.
The laws of India, excluding its conflicts of law rules, shall govern this Agreement and your use of the Application. Your use of the Application may also be subject to other local, state, national, or international laws.
Changes to this agreement
We reserve the exclusive right to make changes to this Agreement from time to time. Your continued access to and use of the website constitutes your agreement to be bound by, and your acceptance of, the terms and conditions posted at such time. You acknowledge and agree that you accept this Agreement (and any amendments thereto) each time you load, access, or use the website. Therefore, we encourage you to review this Agreement regularly.
If, within thirty (30) days of us posting changes or amendments to this Agreement, you decide that you do not agree to the updated terms, you may withdraw your acceptance to the amended terms by providing us with written notice of your withdrawal. Upon providing us with the written notice of the withdrawal of your acceptance, you are no longer authorised to access or use the website.
No Employment or Agency Relationship
No provision of this Agreement, or any part of relationship between you and nViews Career, is intended to create nor shall they be deemed or construed to create any relationship between you and nViews Career other than that of and user of the website and services provided.
You acknowledge and agree that your breach of this Agreement would cause nViews Career irreparable harm for which money damages alone would be inadequate. In addition to damages and any other remedies to which nViews Career may be entitled, you acknowledge and agree that we may seek injunctive relief to prevent the actual, threatened or continued breach of this Agreement.
The headings in this Agreement are for reference only and shall not limit the scope of, or otherwise affect, the interpretation of this Agreement.
The Company is based in India and provided for access and use primarily by persons located in India, and is maintains compliance with India laws and regulations. If you use the website from outside India, you are solely and exclusively responsible for compliance with local laws.
Limitation of Time to File Claims
Any cause of action or claim you may have arising out of or relating to this agreement or the website must be commenced within one (1) year after the cause of action accrues, otherwise, such cause of action or claim is permanently barred.
The Agreement constitutes the entire agreement between you and nViews Career regarding your use of the Application and supersedes all prior and contemporaneous written or oral agreements between you and nViews Career.
You may be subject to additional terms and conditions that apply when you use or purchase other nViews Career’s services, which nViews Career will provide to you at the time of such use or purchase.
